  • Not to worry - we work with you to monitor your texting usage based on your following / subscriber rates. We can initiate the conversation with you on if we need to explore moving up a package to accommodate a larger bank of texts.

    Laws and regulations governing text messaging are very different compared to regular communication channels. Penalties for non-compliance are much greater which is why understanding texting compliance is critical.

    The TCPA stands for “Telephone Consumer Protection Act” and is the federal legislation (originally written in 1991) that governs telemarketing, text messaging, and the Do-Not-Call list. While these laws don’t explicitly mention anything about SMS, it’s been ruled that texts are treated as phone calls under the TCPA. These laws exist to protect people from unsolicited text messages and phone calls.

    The CTIA stands for “Cellular Telecommunications Industry Association” and is a trade group that represents wireless carriers and others in the telecom industry. The CTIA’s guidelines align with TCPA laws to protect people from unwanted text messages but extend further to help marketers create a better experience for consumers.

  • SMS short codes are typically a 5 or 6 digit phone number that is used to streamline the opt-in process.

    It is important to understand that short codes are not sold, they are leased by the regulatory body CTIA (Cellular Telecommunications Industry Association). Typically short codes cost from $500-$1,000 per month with a ~$2,500 set up fee. The process to apply and obtain a short code on average takes 4 months.

    We do not recommend going down this path with our clients as the texting volumes and cost do not make sense for the average business case.
